These Terms of Use (“Terms”) govern the access and use by you of the technology, applications, websites, content, products, and Services made available by “Futuro Agility Care” (brand under Futuro Agility Care Pvt. Ltd.) collectively also referred as (“we” or “us”).

1. About Futuro Agility Care

Futuro Agility Care provides independent health caregivers (“CareGivers”) for in-home personal care (“Service”) for you or another person who is a parent or relative(“Patient”). Futuro Agility Care does background and experience verification of these Care Givers via independent background verification company. The Service is provided by these Care Givers only and not by Futuro Agility Care.

2. Customer Agreement

You on behalf of Patient request Futuro Agility Care to provide Service at home or any other location agreed with Futuro Agility Care. You agree that the Service is advised by a legal medical practitioner and you undertake the responsibility of Service and risks involved. Futuro Agility Care will ensure high quality of Service but will not be responsible for any Service error including criminal activity by CareGivers. You understand and agree that the Service offered by Futuro Agility Care directly or through CareGivers/affiliates of Futuro Agility Care has a risk of failure and/or adverse effects resulting in possible mortality or permanent disability. You understand and agree that Futuro Agility Care does not guarantee any recovery or outcome from the Service offered. You agree to provide safe environment for CareGivers to discharge their duty and you will ensure that they are not harassed, abused or troubled in any way physically or emotionally. You authorise Futuro Agility Care to collect Patient’s data and use/share the same with others (without revealing Patient’s identity). Futuro Agility Care will not be responsible for misuse of Patient’s data by CareGivers, affiliates, employees or other party. You will make payments to Futuro Agility Care as per the terms agreed and will not link it with outcome of the Service.

3. Scheduling Appointments

Appointments for Service with Futuro Agility Care can be scheduled through the Futuro Agility Care website or by calling +91 70779 03111 Your request for Service is only accepted when you receive a booking confirmation from Futuro Agility Care.

4. CareGiver Selection

Futuro Agility Care has a pool of Care Givers to choose from to provide the Service. Futuro Agility Care will ensure that the Care Giver assigned is as per your preference but this may not be possible all the time. Futuro Agility Care reserves the right to assign any Care Giver as it deems fit for that Service. Futuro Agility Care does not guarantee that same Care Giver is assigned on all days. Futuro Agility Care can assign any CareGiver on any day as it deems fit without prior notice.

5. General Payment Terms

The payment can only be made via cash, payment gateway, Online, You agree to make payment as soon as the demand is raised. Futuro Agility Care reserves the right to cancel an on going or future appointment if payments are not made on time.
Taxes: All Charges and fees are exclusive of applicable taxes. Additional taxes will be applicable as per the rules.

6. Payment Policy

• • Applicable Services: All Services including Attendant, Nursing Care, Critical Care, Infant Care, Rehab Care except Physio and short term intervention service.
  • Only Direct Payment to Futuro Agility Care: You don’t have to pay the caregiver in cash or cheque unless asked by the Futuro Agility Care Customer Service team. You will be paying Futuro Agility Care directly Online/App.
  • Payment Mode: Online, NEFT, and Cash payments are accepted. Futuro Agility Care promotes and prefers online payment in advance which enables us to pay our caregivers in time without hassle.

7. Payment Facilities

• • Advance: This will be an advance payment service, you will need to pay 30/90/365 days payment in advance as per the selected plan.

8. General Terms and Conditions on Payments

• • Futuro Agility Care won’t be accountable if any amount is paid to CG. The service fee has to be paid to Futuro Agility Care and under no circumstances the amount paid to the CG will be adjusted with the service fee.
  • 30 days after the overdue date, if payment is not done the case will be legally filed and the dispute will be resolved in Odisha/Karnataka district courts.
  • The above-mentioned amount only includes payment charges for those visits where the attendance of the caregiver has been verified. The mentioned amount is not for the visits to date and it shouldn’t be considered as the final amount, charges for the unverified visits will be added after getting a confirmation from the customer as well as the caregiver.

9. Refund Policy

• • Once the refund is initiated, your balance amount will be credited to your account within 30 working days.
  • Refund will be done only through NEFT.

10. Cancellation Policy

• • You may cancel or reschedule any appointment by calling +91 70779 03111 or through the website or email info@futuroagilitycare.com, no later than 24 hours prior to the scheduled appointment else you will be charged @100% of the service charge.
  • In case of request for rescheduling Futuro Agility Care does not guarantee that it will be able to provide the same Caregiver again and on the rescheduled time.
  • Futuro Agility Care may cancel or reschedule any appointment without prior notice.

11. Intellectual Property Rights

All the intellectual property used on the Websites by Futuro Agility Care, service providers or any third party shall remain the property of Futuro Agility Care, service provider or any other third party as the case may be. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any materials or enforce limitations on use of the Website or the materials therein. The Service is protected to the maximum extent permitted by copyright laws, other laws, and international treaties. Content displayed on or through the Services is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws. The materials on the Websites or otherwise may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means.

12. Limitation of Liability

In no event shall Futuro Agility Care be liable for any special, incidental, indirect or consequential damages of any kind in connection with these terms of use, even if user has been informed in advance of the possibility of such damages. In no event shall the total aggregate liability of Futuro Agility Care to a user or professional for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this agreement or a user’s use of the website.

13. Information You Provide Futuro Agility Care

When you request a Service from Futuro Agility Care, you agree to provide personal information about yourself and the Patient such as name, mobile number, date of birth, gender, weight and medical information about the Patient relevant to the Service. You agree to provide accurate personal and medical information about the Patient and your failure to do so may result in adverse consequences in delivery of Service. Futuro Agility Care may provide this information to assigned Care Giver as it deems fit.

14. Customized service and payment flow

Every patient is different. At Futuro Agility Care, upon receiving your request, we have a detailed conversation with you about your specific medical condition, and then suggest the best course of action. We ask for a payment only when you agree with our proposed plan of action as well as the costs involved. We can request online payments through SMS, email, website. Which also simultaneously clarifies the details of your booking. We use third-party payment service providers to make it easy for you to pay. Except in urgent situations, we commence the service only upon receiving the payment.

15. Communications from Futuro Agility Care

You agree on behalf of yourself and the Patient to receive communication in the form on SMS messages , email and calls on your mobile number and email id from both Futuro Agility Care and the Care Giver assigned to you. You agree to receive promotional messages in the form of newsletters, special offers and reminders and updates.

16. Termination

Futuro Agility Care may immediately terminate the Service at any time for any reason, through notice sent by post on registered postal address or email communication on registered email address.

17. Choice of Law

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Odisha/Karnataka.
